Nevada Businesses Must Accommodate Breastfeeding Under New Nevada Law

What happened?

On May 30, 2025, Nevada Governor Joe Lombardo signed Assembly Bill 266 into law (Chapter 121), expanding civil rights protections to include individuals who are breastfeeding in public places.


Overview:

What It Does: AB 266 updates Nevada’s public accommodation law to:

  • Prohibits discrimination against breastfeeding individuals in public-facing businesses.
  • Requires the state to promote public education and resources on breastfeeding.
  • Allows enforcement through lawsuits and complaints to the Nevada Equal Rights Commission.

Who Is Covered: The law applies to businesses open to or serving the public, including Hotels, restaurants, retail stores, gyms, schools, hospitals, and online businesses.

Enforcement: Violations may result in:

  • Civil lawsuits for damages and attorney’s fees.
  • Complaints to the Nevada Equal Rights Commission, which may order corrective actions.
