What happened?

On May 26, 2025, Nevada Governor Joe Lombardo signed Assembly Bill 305 into law, establishing new limits on fees health care providers may charge for completing Family and Medical Leave Act (FMLA) certification forms.

Overview of AB 305: introducing a standardized fee cap to improve access and transparency for employees seeking medical leave.

  • Fee Cap: Health care providers in Nevada may charge no more than $30 to complete FMLA certification paperwork.
  • Annual Adjustments: Starting in 2027, the cap will be updated yearly based on inflation, using the Consumer Price Index (CPI).
  • Public Posting: Updated limits will be published annually on the Nevada Department of Health and Human Services (DHHS) website.


What Employers Should Know

  • No Change in FMLA Rules: AB 305 does not alter employer rights or obligations under federal FMLA law.
  • Improved Accessibility: Lower fees may encourage more employees to request leave and complete required paperwork.
  • Potential Delays: Some providers may deprioritize paperwork due to the capped fee, especially if no appointment is scheduled.
