Reminder Federal: EEOC Proposed Revisions to the Pregnant Workers Fairness Act (PWFA) Regulation

We want to remind employers that on November 21, the Equal Employment Opportunity Commission (EEOC) published a notice of proposed rulemaking to revise the language of the EEOC’s existing recordkeeping regulations. Written comments must be received on or before January 21, 2025.

  • A public hearing concerning adding the Pregnant Workers Fairness Act (PWFA) to the EEOC’s recordkeeping rules will be held on January 8, 2025, at 10:00 a.m. Eastern Time.
  • The hearing will take place at EEOC Headquarters, Jacqueline A. Berrien Training Center, 131 M Street, NE, Washington, D.C. 20507. The public may attend in person, and ASL services will be available.
  • Persons wishing to speak about the recordkeeping proposal at the hearing must submit a written request to the EEOC by December 23, 2024. This request should include their contact information and a written summary of the remarks to be offered.
